Congress Lifts Hemp Prohibition!

Earlier this week, on December 10th, 2018, the much anticipated passing of the 2018 Farm Bill ends the era of hemp prohibition. According to the US Hemp Roundtable General Counsel Johnathan Miller, hemp is permanently removed from the Controlled Substances Act (CSA) and forever deemed an agricultural commodity, no longer mistaken as a controlled substance. Both the World Health Organization and the U.S. Food and Drug Administration (FDA) have declared, after intense scientific scrutiny, that CBD is safe, non-toxic, and non-additive.

By redefining hemp to include its “extracts, cannabinoids and derivatives, ” Congress explicitly has removed popular hemp products—such as hemp-derived cannabinol (CBD)—from the purview of the CSA. Accordingly, the Drug Enforcement Administration no longer has any possible claim to interfere with the interstate commerce of hemp products. This should give comfort to federally regulated institutions—banks, merchant services, credit card companies, e-commerce sites and advertising platforms—to conduct commerce with the hemp and hemp product industry.

This also means that Hemp farmers now may finally access needed crop insurance and can fully participate in USDA programs for certification and competitive grants.

Hemp farmers, cultivators and businesses have been waiting a long time for Congress to get up to date on the facts about hemp, and now that this day has finally come, the impact on a more sustainable lifestyle and reduction in global waste will be monumental.
